Terms And Conditions

1) TERMS AND CONDITIONS: All rentals are subject to the terms and conditions set out in the rental contract, as well as to the discretion of SICILIANA CAR, in relation to the suitability to drive and the customer’s reliability. The prices indicated are expressed in Euros and include 22% VAT.


2) AGE OF THE DRIVER: For groups of categories A, B, C, D, E the age of the driver must be between 21 and 75 years.


3) DRIVING LICENSE AND IDENTIFICATION DOCUMENT: A category B driving license and a valid identification document must be requested from the driver when signing or accepting the contract. Photocopies or replacement certificates cannot be accepted.


4) CAR CHECK: Before signing the vehicle delivery contract, the customer is required to check that the condition of the vehicle corresponds exactly to the vehicle card delivered, paying particular attention to any damage to the external bodywork, glass, mirrors, upholstery, rims and wheel covers and undertakes to return it in the same state as with collection. In the case of return during the office closing time, the customer is held responsible for all possible damages suffered by the vehicle when the offices are open, including the theft of the key. Upon delivery, the vehicle will be supplied with a triangle and a colored jacket.


5) BASIC SERVICES INCLUDED IN THE RATE: The basic services included in the rate include: RCA insurance, unlimited KM, 24/7 roadside assistance, INA 22%, taxes and charges.


6) INSURANCE: The vehicles are already insured for civil liability towards third parties (RC), animals and things. Persons transported in the rental car are also defined as “Third Parties”. All rates include a maximum liability for damage, theft and fire within the limits of the deductible which varies according to the group hired: CAR GROUP A/B/C/D DAMAGE EXCESS EURO 750 / CAR GROUP A/B/C/D THEFT AND FIRE EXCESSIT EURO 1,200 In the case of furo in Calabria, Campania and Puglia, a fee of 800 (eight hundred) euros must be paid in addition to the Deductible provided for in the contract.


7) GLOBAL INSURANCE – CASCO: Elimination of liability for damage, theft and fire. Exclusion of liability of the customer in case of damage found on the rented vehicle, in case of theft or fire of the vehicle. It is not an insurance coverage but a reduction of the customer’s responsibility in case of damage to the vehicle. If requested and signed at the time of rental, it reduces the deductible for damages, in the event of an accident/collision, theft and fire to €0.00. This disclaimer clause does not in any case include damage resulting from natural disasters, atmospheric elements, damage from vandalism, damage from incorrect refueling, damage to the mechanical parts of the vehicle, to the upholstery, to the passenger compartment, to the underlying part of the vehicle , damage caused by vegetation, as well as the loss of documents, keys and car number plate, glass and tyres. In any case, the customer forfeits all the benefits of the elimination of liability clause in the event of failure to return the car keys or failure to deliver the theft report presented to the competent police authorities; in these cases, the customer is obliged to pay the Lessor the full value of the vehicle according to the yellow Eurotax price list. The cost is per day and varies according to the group of rented vehicle. In the event of theft in Calabria, Campagna and Puglia, a fee of € 800.00 must be paid in addition to an excess provided for in the contract. This reduction operates only on condition that the event is not attributable to gross negligence, or gross willful misconduct or fault of the customer, pursuant to art. 1229 of the Civil Code.


8) WEATHER EVENTS PROTECTION: Exclusion of liability for damage to the vehicle as a result of hail, tornadoes, storms, hurricanes, landslides, landslides, floods, avalanches, avalanches and floods. The cost is per day and varies according to the group of vehicles rented. The customer declines all responsibility.
9) VANDAL ACTS PROTECTION: Exclusion of liability for material and direct damage suffered by the vehicle as a result of riots, strikes, acts of terrorism and acts of vandalism with the exclusion of those suffered by the vehicle and its accessories during or as a result of circulation following the occurrence of the event. In any case, the customer loses all the benefits of protection in the event of negligence, willful misconduct or gross negligence pursuant to art. 1229 of the Civil Code. The cost is per day and varies according to the group of vehicle rented.


10) GLASS PROTECTION: Exclusion of liability for the replacement or repair of the crystals as a result of their breakage due to accidental causes or acts of third parties. The protection applies only to the following windows: windscreen, rear window and side windows. in any case, the Customer loses all the benefits of protection in the event of negligence, willful misconduct or gross negligence pursuant to art. 1229 of the Civil Code. The cost is per day and varies according to the group of vehicle rented.

11) TIRE PROTECTION: Exclusion of liability for damage to tires as a result of the use of the rented vehicle. In any case, the customer loses all the benefits of protection in the event of negligence, willful misconduct or gross negligence pursuant to art. 1229 of the Civil Code. The cost is per day and varies according to the group of vehicle rented.


12) EXTRA ACCESSORIES: Satellite Navigator € 5.00 per day – High chair for children € 7.00 per day – Snow chains € 10.00 for the entire duration of the rental – Super Helmet € 850.00 for the entire duration of the rental.


13) TRAVEL ABROAD: It is permitted to drive the vehicle only in Italy.


14) ROADSIDE ASSISTANCE: All rentals include H24 roadside assistance. in the event of a road accident, breakdown, theft and robbery, fire, etc., the operations center sends an emergency vehicle to resolve the cause of the immobilisation, or tows the vehicle to the nearest authorized workshop. If the fault cannot be repaired within 2 hours, a taxi refund of up to € 100.00 is provided


15) IN THE EVENT OF ACCIDENT, THEFT AND FIRE: In the event of an accident, the Customer is required to fill in the CAI accident notification form together with the counterparty and to promptly notify Siciliana Car within 24 hours of the event. In the event of theft and fire, the customer is required to communicate by telephone and/or email about what happened and go to the police authorities to report the incident. The vehicle keys and the original of the report must be delivered by the end of the rental.


16) REPLACEMENT CAR: In the event of a breakdown of the rented vehicle, not attributable to the customer, Siciliana Car, according to availability, guarantees the replacement of the vehicle if it is not in a position to be repaired in a short time. In the event of lack of availability, Siciliana Car will issue a refund equal to the rental period not used by the customer. In the event of a fault attributable to the customer, Siciliana Car does not guarantee the replacement of the vehicle if it is not in a condition to be repaired in a short time and no refund is foreseen.


17) RENTAL EXTENSIONS: It is possible to extend the rental only after prior communication from the customer and authorized by Siciliana Car. The customer must contact and schedule, if possible, the extension of the contract.


18) VEHICLE RETURN: The customer undertakes to return the vehicle to the place and within the date and time specified on the rental contract. The duration of a rental day is H 24 calculated from the time of delivery of the vehicle. There is a 30-minute delivery time tolerance, in which case a rental day will be charged.


19) PAYMENT: The payment conditions will be agreed between the parties, including security and deposit.


20) FINES AND TOLLS: The customer undertakes to compensate Siciliana Car for any fines incurred during the rental period and for any unpaid motorway tolls. The customer is also required to pay Siciliana Car € 60.00 as reimbursement of expenses relating to each fine or unpaid toll. The aforementioned administrative expenses will also be due in the event that the driver has raised the fines despite acting in conditions of legitimacy and having recognized the lawfulness with a judicial provision.


21) FUEL REFUELING SERVICE: The cars are delivered for hire with a certain amount of fuel. If the car does not return with the same quantity of fuel, the missing liters will be charged in addition to a supplement for non-refueling of € 25.00.
